GENERAL RULES

‣ Please do not heavily reference my premades.
‣ Back charging money will result into a permanent black-list + your right will be revoked to use the art piece and it will be resold.
‣ All premades you buy from me are for personal use only, not for commercial use. (do not make any money off of them)
‣ Do NOT use any of my drawings through AI generators / apps, I do not support AI art related generators / apps / software right now.
‣ Please do not efit any of the pieces you receive unless permission from me has been granted.
‣ No refunds are allowed unless i offer them myself, or there is an emergency reason (must show proof of this)

TOS RULES FOR PREMADES:

RESELLING / SHARING / GIVING AWAY PREMADES

‣ PREMADES will only be sold through my resell system in my server. (You can read the rules and info in that channel in my server) GIFTS cannot be resold
FOR EMERGENCY RESELLS - these can be sold outside of the resell system. An emergency = a serious, unexpected and often dangerous situation requiring immediate action. Basically as extreme as life or death scenarios. So once again, it has to be a serious situation.‣ You are not allowed to give away / swap any of the pieces you buy from me in anyway, shape or form.‣ Sharing is only allowed if it's between your own accounts, fully used and owned by YOU only. if I find out it's not your alt but someone else's account, you will be blacklisted.‣ Please refrain from allowing others to co-own the premade piece as a reference etc, the premades you buy are for you and you only once bought.‣ FOR COUPLE PIECES there has to be 1 owner. You can't both own the piece, please keep this in mind before purchasing couple pieces or resells. This is because in the past there have been too many times where friends / people break up and it got messy.

BUYING PREMADES

‣ I wont hold premades. The information in the auctions for premades mentions how long you have to pay for a piece.‣ I'll only allow payments through invoices. I'll ask you to send/dm your PayPal email if the premade is sold to you, then i'll create the invoice.‣ I no longer sell premades for flat prices. From now only free giveaway pieces will only be done through random generator method (winned chosen randomly).
Premades will only be sold through auctions.‣ The amount of premades you're allowed to win / purchase / bid on through the auctions is usually mentioned in the information of the auctions themselves in my server.‣ When a premade is up for giveaway through the random generator method, you can only enter in for yourself.

TEXT ON PREMADES

‣ Retexts only costs extra if its asked for once a piece / pieces have had text put on them already.‣ Text changes cost $10usd, in the past I was offering it for free. But due to my health issues and it being time consuming it's not possible for me to do anymore.
(This price is for all versions of the piece / pieces, for example gif version + non gif + 2 resized versions. 4 pieces in totel)‣ I do not five textless display pictures. (for safety reasons)‣ The watermark HAS to be @ a social media (IMVU, twitter, arthaven etc) for safety reasons as well, the main text can be whatever you want. This is for safety reasons, so that your piece can be tracked back to you if it ever ends up somewhere it does not belong.

CHANGES ON PREMADES

‣ As of right now, i do not allow changes on premades.
EXECPTION FOR CHANGES: Your piece got taken down for being NSFW (on IMVU or other places). If thats the case please sense me the proof that it got taken down + the imvu staff for example making it clear WHAT exactly about it is considered AP. And I will then make adjustments for free.

TURNING THE PREMADE CHARACTER INTO AN OC

The characters sold in the display pictures are allowed to be turned into OC's. However, please inform me first if you will turn them into OC's. Please refer to the adoptable rules below for guidelines reguarding changing / adding things to the character.

EXTRA RULES FOR ADOPTABLES

‣ All of the rules here apply to adoptable premades too.‣ You are not allowed to resell or trade the adoptables once you've purchased them. Reselling may be allowed in the future once i figure out a method for doing so.‣ The premade adoptables are for personal use only, not commercial use. This means that if you make a badge on IMVU of a character / adoptable you bought from me and use that badge to earn money to create or sell the badge, it's considered commercial use which is not allowed.‣ The only 'commercial use' I will allow is for streamers (twitch/youtube etc) for art to be made for the channel ONLY. This means no merch of the character is allowed. Vtuber models are also allowed but not allowed to be resold after that.‣ Original designs rights belong to me, but the character rights are yours once purchased.‣ You may alter the outfit / hair / colour scheme / body shape if you prefer to increase or decrease certain sizes. However, please do not change everything to the point of it being unrecognizable.‣ The story behind the character you adopt is completely up to you, this also means the name or where he/she/they/it comes from / what species he/she/they/it is etc.‣ Would be appreciated if you could credit me aswell ♡

TOS RULES FOR CUSTOMS:

‣ All art pieces you buy from me are for personal use only, not commercial use. (don't use them for profit and do not use them for NFTs) You may post them on your social media as long as it's for personal use.‣ I don't mind changing things up slightly here and there, just please try to keep it at 3 adjustments max per wip as there will be many wips anyway. I also don't mind testing things out for full custom pieces.‣ I try to start on it as soon as i can if it's partly or fully paid for, if i am very busy or unwell I m ight give you a heads up before ordering how long it could take for my to start/complete your piece. On the side I also work on premade auctions which are my main source of income so i need to prioritize that, giveaways, other projects and of course IRL, so this could interfere with working times sometimes. I also have ADHD and Bipolar + other physical pain which heavily effects my energy to work. So please bare with me.‣ Please contact me if you need a payment plan. With payment plans the amount of work I do on your piece depends on how much you've paid off.‣ I will only accept payment via PAYPAL. Customs are done through invoices. Once we've both agreed to the price, and you're ready, I'll send you an invoice.‣ Refunds will only be allowed in extreme cases.‣ For personal reasons / if you break my TOS, i have the rights to decline to do further business you with and cancel and ongoing commission + refund you.‣ For my safety as an artist and business owner i do not do business with people below the age of 18, if you somehow slip through and i find out you are below 18 i will cancel / revoke the piece i created for you / sold to you and refund + then resell the piece to earn my money back. (and change up the piece if it was a custom)‣ Please keep in mind that for 160x220 sized pieces, super vibrant pieces in gif format usually look even more pixelated.‣ I do not give textless 160x220 art pieces.‣ The small watermark on the 160x220 pieces HAS to have a social media on it (like @imvu, @instagram etc) so that people can track you back incase of art theft.‣ Do not share the piece for others to use, these custom pieces are made for you and only you to use. You can use them on an alt account but that account HAS to belong to you and you only. If it's a shared alt account or an account thats not yours at all, you will be blacklisted.‣ PLEASE THINK BEFORE YOU BUY For custom pieces, if you are selling your OC my pieces can only be included (for free) if other artist's pieces are included too, expect you're not allowed to price mine. Basically, my art pieces made for you will only serve as a reference for the next owner and not as a picture for them to use as profile picture (as the text wont be changed on it).
It is this way because i've let custom pieces be sold in the past and it was complicated.

THEFT

Please keep in mind that im only one person, i am not able to see theft across the entire internet. It's hard for me to keep track of theft by myself. If you see anything that looks like stolen art please don't hesitate to contact me.I try my best to prevent people from stealing by adding watermarks and text. This isnt always enough but it does make it easier for other users and me to find the original owner and inform them or me.I also try my best to file the DMCA and take the images down if the theif wont take the art piece down. Generally it takes about 1 week or more for the DMCA to take action, however they can take longer depending on the situation or website.
Regardless, I'll keep trying until the DMCA takes it down or the thief themselves do.‣ If you spot that there's an artist / user copying your OC that I created for you, please report it to me and we can take care of it further.‣ If you notice a user using the art I created for you on IMVU or elsewhere, please report it to me and I'll contact the website + thief + file the DMCA if necessary.

WHAT ARE 160X220 PREMADES?

160x220 premades are art pieces that are already finished and ready to be sold as they are, reason why they are so small (160x220pixels) is beacuse these types of premades are mainly made for the 3d chat program imvu. you could see these pieces as adoptables. examples can be seen above.

how do commissions work?

due to health issues combined with my ADHD and bipoler disorder i currently only open commissions rarely / few slots at a time since it heavily effects the amount of energy i have.since auctions are my main income i usually will work on commissions after they are done until i have to start working on auction pieces again. so if you do decide to order, please keep this in mind.for now i am keeping it simple and only offering semi real pieces.below you can see the pricing (may change in the future depending on demand / health)
